At Charpentier Law Firm, we are well known for our expert handling of auto accident cases. However, our personal injury attorneys also have extensive experience and a history of success in representing victims of pedestrian accidents. Like auto accident cases, pedestrian accident cases are often highly complex, requiring meticulous investigation and accident reconstruction. We use all of the resources at our disposal to present the strongest cases possible on behalf of our injured clients and their families.

One of the reasons pedestrian accident cases can be so complex is because there are so many different types of pedestrian accident cases, especially in a city like Melbourne, FL, where pedestrian and bicycle traffic is so heavy. Cars, trucks, motorcycles, and other motor vehicles have to share the roads of our city with thousands of pedestrians each day, and a lack of vigilance on the part of the drivers of these vehicles can be potentially deadly.

If you or a member of your family has been injured while traveling by foot by the negligence of the driver of a motor vehicle, or if you have lost a member of your family due to such negligence, one of our personal injury lawyers can help. We will fight to assert your rights. Please contact Charpentier Law Firm today to arrange for an evaluation of your pedestrian accident case.

What Are the Most Common Types of Pedestrian Accidents?

Pedestrians are, by nature, the most vulnerable and unprotected class of people traveling on our nation’s roadways. While bicyclists and motorcyclists aren’t afforded the external protection that drivers of cars, trucks, and vans are, they are at least protected by their safety gear, assuming that they are properly equipped. Most pedestrians, however, are wearing no more than their clothing and are completely unprepared for the possibility of being struck by a motor vehicle.

The most common types of pedestrian accidents include:

  • Crosswalk accidents: These often occur because drivers of motor vehicles fail to yield the right of way to pedestrians in crosswalks. Pedestrians have the right of way in marked crosswalks; however, they should always lock eyes with drivers to make sure that it is safe to cross before proceeding. Even so, other vehicles have been known to illegally pass vehicles that have stopped to yield the right of way to pedestrians in crosswalks, thereby striking the pedestrians.
  • School bus accidents: By law, drivers of motor vehicles must stop when a school bus is unloading its passengers at a bus stop. When they don’t, there is a risk that they might collide with a child pedestrian.
  • Parking lot accidents: Pedestrians have the right of way in a parking lot. Drivers must be vigilant. Unfortunately, in their rush to find parking, many are not.
  • Sidewalk accidents: Whether due to being distracted, reckless driving, driving under the influence, or another reason, drivers sometimes drive onto sidewalks and strike pedestrians.
  • Other accidents: Other common accidents include striking people getting out of parked cars, hitting pedestrians legally crossing the street while making right turns at green lights, and the sideswiping of pedestrians.
