Lawsuits NOT the cause of soaring health care costs

Posted under: Medical Malpractice — Charpentier Steve @ 6:56 am

Florida Today- July 7, 2009- Matt Reed. Lawsuits are not the force behind rising health care costs in Florida. An analysis of state data regarding FL medical malpractice cases from the past 5 years shows evidence of fewer lawsuits (annual number of malpractice suits per Floridian has dropped 8% since 2005), lower litigation costs (claims resolved for an average of 57 cents on the dollar), and cheaper malpractice insurance (average doctor’s insurance premium has declined by 8%), yet the cost of health insurance premiums continues to rise. While tort reforms imposed by voters and the FL Legislature in 2003 and 2004 made it more difficult to bring medical malpractice lawsuits in the state, these reforms did nothing to lower the cost of health care. These restrictions, such as a cap on damages for suffering, a restriction of attorneys’ contingency fees, and special requirements of patients seeking to bring suit (patients must pay a doctor for a case review and affidavit to even have the chance to bring suit) have simply resulted in a limitation of patients’ rights, while doing nothing to lower the cost of health insurance or increase the quality of health care in the state.

Bridgestone Motorcycle Tire Replacement on Certain Triumphs

Posted under: Product Liability — Charpentier Steve @ 5:37 am

Model: Bridgestone Exedra G850 G 180-70R1677H, 2008-2009 Triumph Rocket III – Bridgestone America’s tire operation (Bridge Stone) is recalling 1,018 Bridgestone Exedra G850 G motorcycle tires, size 80-70R1677H, sold as original equipment for MY 2008 and 2009 Triumph Rocket III touring motorcycles. The motorcycle to which these tires are applied develops very high torque and can cause torque-induced degradation in a body ply which may result in inner liner cracking that may lead to a slow leak in the rear tire. Apparently this condition does not affect the front tire. Consequence: The affected tires may begin to vibrate at moderate speeds. Continued use of a tire with this condition can lead to a vehicle crash. Remedy: Bridgestone is working Triumph to notify owners and the defective tires will be replaced free of charge. In addition, the front tire will be replaced free of charge to the matching requirements of the motorcycle. The safety recall is expected to begin during April 2009. Owners may contact Bridgestone toll free 800-465-1904 NHTSA Campaign ID# 09T004000
