Premises liability lawsuits can be brought against owners of buildings like those owned by the government or a business. It basically involves injuries or deaths that occur on these kinds of premises. These occur when owners of such buildings have not adhered to the required safety standards to prevent injury or death.

There are many scenarios that can lead to a premises liability lawsuit like an unsafe building, sidewalk, stairs, balcony, or a bridge that collapses inadequate security on the property, presence of an animal that attacks. The most common cases under premises liability law may include slip and fall, being hit by a falling object, dog bite, fire, and sexual assault made possible by inadequate security. In cases where the cause of an injury is not clear, expert witnesses may be called in, such as a safety engineer, architect, industrial hygienist, or property management expert.

The kind of premises that can find themselves sued under premises liability law include private residences, retail stores, shopping malls, supermarkets, schools, parks, restaurants, bars, nightclubs, hotels and motels, parking lots, parking garages and ramps, stadiums, amusement parks, and other commercial properties.

The damages that may be paid in a premises liability case include medical care, rehabilitation costs, and in the case of death funeral and burial costs, loss of companionship and support, lost wages or earning capacity, pain and suffering.

As with all legal procedures it is good to research your lawyer or other legal counsel before committing your case to him or her. An experienced lawyer knows his or her way around the system, which is important in cases where causality is not easy to prove. They will dig the books to get you paid the damages you deserve. Another way to check out whether the lawyer you are hiring is worth your money is to check the local lawyers association register to see if they have a good record and their permit or license is in order.
